These Terms and Conditions ("Terms") govern your access to and use of the mobile application BuzzTrader (the "App") and any related services, features, or content provided by BuzzTrader, Inc. ("BuzzTrader", "we", "us", or "our"). By downloading, accessing, or using the App you agree to be bound by these Terms. If you do not agree with these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App you accept and agree to be bound by these Terms and any policies referenced herein (including our Privacy Policy). We may revise these Terms from time to time; continued use after changes indicates your acceptance of the updated Terms.

2. About the App / Permitted Use

BuzzTrader is an information service that analyzes news articles and other publicly available content to surface potential trading ideas, research summaries, and market analysis ("Insights"). The App is intended for personal, informational, and research use only — not for professional investment advice. You agree to use the App only in accordance with these Terms and applicable law.

3. Eligibility; Account Responsibility

You must be at least 18 years old to use the App. By using the App you represent and warrant that you meet the age requirement and have the legal capacity to form a binding contract. You are responsible for all activity on your account and for keeping your login credentials secure.

4. User Content; Uploads & Processing

• Uploads. The App may allow you to upload content (for example: chart images, screenshots, or other files) to generate insights or to help personalize results. You retain ownership of any content you upload.

• License to Use. By uploading content you grant BuzzTrader a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, process, store, and display that content solely to operate, provide, and improve the App and related services (including training de-identified models), and to comply with legal obligations.

• Responsibility. You are solely responsible for your uploaded content and warrant that you have all rights necessary to upload and permit the uses described above. Do not upload content that violates a third party’s rights, contains personal data of others without consent, or is otherwise unlawful.

• Retention & Privacy. Uploaded content may be retained subject to our Privacy Policy. We take commercially reasonable measures to protect uploaded content but cannot guarantee confidentiality or security in all circumstances.

5. Source Material, Third-Party Content & Accuracy

• The App aggregates and analyzes news and third-party content. Third-party sources may include news outlets, data providers, social platforms, and public filings. We do not control those sources.

• No Guarantee of Accuracy. While we use automated systems and human review to generate Insights, we do not guarantee the accuracy, completeness, currency, or reliability of any content, Signals, or recommendations. News may be delayed, incomplete, or incorrect.

• Third-Party Services. The App may link to or integrate third-party services. Your use of third-party services is governed by their terms and not by BuzzTrader. We are not responsible for third-party content or availability.

6. No Financial or Investment Advice

All content in the App, including predictions, trade ideas, strategies, or analyses (collectively, "Insights"), is provided for informational and educational purposes only and does not constitute financial, investment, tax, legal, or trading advice. Insights may be produced by AI algorithms and are inherently speculative. You should not rely on the App as a substitute for licensed financial advice or your own independent due diligence. You are solely responsible for any trading or investment decisions you make.

7. Intellectual Property

• Our Rights. BuzzTrader (and its licensors) own all rights, title, and interest in the App and its content, software, designs, interfaces, and trade secrets, subject only to the limited rights you are granted herein.

• Your Rights. You retain ownership of user-generated content you upload, subject to the license to BuzzTrader described above.

• Restrictions. You agree not to copy, modify, create derivative works from, reverse engineer, or attempt to extract source code from the App; distribute, sublicense, rent, or otherwise transfer rights to the App; or remove any proprietary notices.

8. Fees, Subscriptions & Payments (if applicable)

If the App offers paid features or subscriptions, charges and terms are presented at purchase. All fees are non-refundable except as required by law or as the applicable subscription terms specify. You are responsible for taxes and for providing accurate payment information.

9. Privacy & Data Use

Your use of the App is governed by BuzzTrader’s Privacy Policy, which explains how we collect, use, store, and share information. By using the App you consent to the collection and use of data as described in that policy.

10. Termination; Suspension

We may suspend or terminate your access at any time for violation of these Terms, or for other lawful reasons (e.g., security or legal requests). You may stop using the App at any time. Termination does not relieve you of obligations accrued prior to termination.

11. Indemnification

You agree to indemnify, defend, and hold harmless BuzzTrader and its officers, directors, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms; (b) your use of the App; or (c) your user content.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ALPHA AI DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM HARMFUL COMPONENTS. ALPHA AI DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ALPHA AI, ITS AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL ALPHA AI’S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO ALPHA AI IN THE PRIOR TWELVE (12) MONTHS (OR USD $100 IF YOU HAVE NOT PAID US).

14. Export Controls & Prohibited Uses

You will not use the App for any unlawful purpose or to violate export laws. You will not use the App to attempt to manipulate markets, commit fraud, infringe privacy rights, or otherwise engage in harmful activity.

15. Changes to Service & Terms

We may modify, suspend, or discontinue the App (or any feature) at any time. We may update these Terms from time to time; when we make material changes we will provide notice as required by law. Continued use of the App after such updates constitutes acceptance.

16. Governing Law; Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which BuzzTrader is incorporated, without regard to conflicts of law principles. Any disputes will be resolved in the courts located in that jurisdiction, unless another dispute resolution mechanism (such as arbitration) is stated elsewhere in the App’s policies.

17. Miscellaneous

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BuzzTrader with respect to the App. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
